- New Jersey Issues Prescriptive Order |

The State of
New Jersey has issued a Prescriptive Order mandating certain
security requirements for the chemical/processing industries in
the state. The PO was issued by Acting Governor Codey last week
and was developed by the NJ Domestic Security Preparedness Task
Force, which is chaired by Attorney General Harvey with input
from the Commissioner of NJDEP. This is the nations’ first
general security regulation of the chemical/processing sector
(the MTSA regulations covers similar facilities transferring
materials at the waterfront).
The PO applies
to certain TCPA and DPCC covered facilities, and includes
requirements for SVAs, security plans, and for TCPA-covered
facilities, a review of inherently safety technologies (IST),
all within 120 days from the date of the order, which was signed
on 11/21/05. This last
provision was included despite the best efforts of
CCNJ and ourselves. If you have received the PO and require
